You will remember the Byway Rules Apply idea in the Solutions paper we took to Defra in Bristol.
One factor about which Defra officers were asking was how effective is the Highway Code provision which says 'This is not the law, but if you fail to follow this advice it can be taken into consideration when deciding on any conviction or sentence.' This is the model on which we suggest the Byway Rules might work best, avoiding a raft of new legislation.
Your members - especially the Police Officers among them - may have experience of this in court, with cases where a fine was increased because the Code had been ignored. Please let me have details of such contacts and any useful examples they can recall. This will help enormously in fleshing-out our proposals, making them look 100% worthwhile.
